Throughout this time, the chiropractic practitioner continued to provide chiropractic services to the female and members of her family, and did not consult from either his associates or his professional body about his professional and ethical obligations. The Chiropractic Board Code of Ethics states that chiropractors have a duty to be knowledgeable about the Board's Code and comply with its requirements. It
mentions that a chiropractic physician can not have a sexual relationship with a client unless that patient is the chiropractor's spouse or partner. Deputy Commissioner Rose Wall thought about that by entering into and continuing a sexual relationship with the lady while providing her with chiropractic
treatment, the chiropractic physician stopped working to keep suitable expert limits and abide by the ethical requirements set out in the Chiropractic Board Code of Ethics. Accordingly, she found that the chiropractic practitioner breached the Code.”The maintenance of professional borders is an important part of the provision of health services, and its value in the provider-consumer relationship can
not be emphasised highly enough,”said Ms Wall.” I consider that [the chiropractic doctor's] conduct, specifically his entering into a sexual relationship with his patient, did not adhere to his professional and ethical responsibilities and crossed expert borders and ethical requirements.”The Deputy Commissioner advised that the chiropractor develop a six-month mentoring and continuing education strategy with the New Zealand Chiropractic Board, in relation to its Code of Ethics and with an emphasis on expert borders. She also advised that the New Zealand Chiropractic Board consider this problem and whether additional action is warranted. The chiropractic doctor is to be described the Director of Proceedings.
